 ates responsibility for\n   downstream harm has never been fully settled\,
  but the practical\n   separation between writing code and being treated a
 s responsible for\n   its downstream use is breaking down across AI\, cryp
 to\, cybersecurity\,\n   and platform law. Courts and regulators are incre
 asingly reaching\n   contradictory conclusions about structurally similar 
 systems:\n   autonomous agents acting on third-party platforms\, open-sour
 ce\n   developers accused of operating financial infrastructure\,\n   secu
 re-by-design evolving into reasonable-care expectations\, and\n   recommen
 dation systems reframed as product design rather than\n   publication. Thi
 s talk maps common doctrinal tension underneath those\n   debates and argu
 es that traditional legal categories fail when\n   control\, deployment\, 
 and operation are distributed across maintainers\,\n   deployers\, validat
 ors\, governance participants\, and autonomous\n   systems. Rather than fo
 cusing on labels like developer or platform\, it\n   proposes a functional
  framework centered on control\, participation\,\n   foreseeability\, and 
 proximity to harm. The current incoherence is\n   itself becoming a system
 ic risk\, and the people building these systems\n   should help shape the 
 framework before courts finish improvising one\n   for them.\n\n   Speaker
